Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes what you may and may not do when using the Services operated by Tikrr LLC ("TIKRR," "we," "us"). This AUP applies to all users of tikrr.com, labs.tikrr.com, and any associated APIs, portals, and applications (collectively, the "Services").

This AUP is incorporated into and forms part of TIKRR's Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. By using the Services, you agree to this AUP.

We built TIKRR for independent painting contractors who run real businesses. This policy exists to protect them, their clients, and the integrity of the platform — not to create bureaucratic friction.

You may use the Services for the following purposes, subject to these Terms and the AUP:

• Managing your painting or contracting business — leads, estimates, field operations, media, and performance tracking
• Inviting authorized employees, subcontractors, and subcrew members to your workspace with appropriate role permissions
• Creating and sending professional proposals, invoices, and communications to your clients
• Sending marketing and outreach email through SalesLab to recipients who have provided the required consent under applicable law
• Accessing and using AI-assisted features (including Taz) to support legitimate business decisions, with human review before acting on outputs
• Connecting authorized third-party integrations (such as Google, Pipedrive, and Stripe) within the scopes you approve
• Exporting your own Customer Data for legitimate business purposes

The following are prohibited. Violations may result in immediate suspension or termination of your account.

3.1 Illegal activity

• Using the Services to violate any applicable law or regulation, including privacy laws, anti-spam laws, consumer protection laws, and trade sanctions
• Processing or storing data in a way that violates applicable data protection law, including GDPR, UK GDPR, CCPA, and PIPEDA
• Using the Services to facilitate fraud, money laundering, or any other financial crime
• Infringing the intellectual property rights of any third party

3.2 Harmful or abusive content

• Uploading, transmitting, or storing content that is defamatory, harassing, threatening, hateful, obscene, or pornographic
• Uploading malware, viruses, ransomware, spyware, or any other malicious code
• Transmitting unsolicited bulk commercial email (spam) or using the Services to facilitate phishing, spoofing, or other deceptive practices
• Harassing, bullying, or intimidating other users, your clients, subcontractors, or any third party through the Services

3.3 Platform abuse

• Attempting to gain unauthorized access to any part of the Services, other users' accounts, or TIKRR's infrastructure
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Services
• Using automated means (bots, scrapers, crawlers) to access, extract, or index the Services without TIKRR's written permission
• Interfering with or disrupting the integrity or performance of the Services, including through denial-of-service attacks or excessive API requests
• Circumventing any technical measures TIKRR uses to enforce these Terms or protect the Services
• Creating multiple accounts to evade suspension, circumvent usage limits, or misrepresent your identity
• Reselling, sublicensing, or otherwise commercializing access to the Services without TIKRR's written consent

3.4 Data misuse

• Uploading Customer Data you do not have the right to collect, process, or store
• Using data accessed through the Services for purposes other than operating your contracting business
• Sharing, selling, or disclosing other users' data or your clients' personal information to unauthorized third parties
• Using the Services to build a competing product or service, or to benchmark against TIKRR for competitive purposes without authorization

3.5 Mass email and outreach

• Sending commercial electronic messages to recipients who have not provided the required consent under CAN-SPAM, CASL, GDPR, or other applicable law
• Using SalesLab's mass email features to send messages unrelated to your painting or contracting business
• Suppressing or circumventing unsubscribe mechanisms — all opt-out requests must be honored within the legally required timeframe
• Falsifying sender information, subject lines, or message headers
• Using purchased, rented, or scraped email lists without verifiable consent documentation

3.6 AI feature misuse

• Submitting prompts or inputs designed to manipulate AI outputs in harmful, deceptive, or illegal ways
• Using AI-generated outputs (from Taz or any other AI feature) without human review for decisions that could materially affect your clients, subcontractors, or business partners
• Attempting to extract training data, model weights, or proprietary logic from AI features
• Using AI features to generate content that violates any other provision of this AUP
• Submitting sensitive personal information (health data, financial account numbers, government ID numbers) to AI features unless you have a lawful basis and explicit authorization to do so

As a TIKRR user or Customer, you are responsible for:

• Ensuring all users you invite to your workspace understand and comply with this AUP
• Maintaining the security of your account credentials and notifying us immediately at support@tikrr.com if you suspect unauthorized access
• Providing accurate information when creating your account and keeping it current
• Ensuring all data you upload, import, or process through the Services was collected lawfully and with appropriate consent where required
• Maintaining your own compliance with applicable laws governing your contracting business, including contractor licensing, insurance, and employment law
• Reviewing all AI-generated content before using it in customer-facing communications, proposals, or business decisions

TIKRR is designed to manage data about your subcontractors, crew members, and clients. You are the data controller for this information. You must:

• Have a lawful basis for collecting and processing the personal data of subcontractors, subcrew members, and homeowners you add to the platform
• Provide your own privacy notices to the individuals whose data you process through TIKRR
• Respond to any data subject requests (access, deletion, correction) from your clients and subcontractors
• Not upload data about individuals who have opted out of data collection or requested deletion of their records
• Ensure that subcontractors and subcrew members who receive limited-access portal invitations are informed of how their data will be used

TIKRR may investigate any suspected violation of this AUP. Depending on the nature and severity of the violation, we may take one or more of the following actions:

• Issue a warning and require corrective action
• Temporarily suspend access to specific features or the entire account
• Permanently terminate your account and all associated access
• Remove or disable any content or data that violates this AUP
• Report violations to law enforcement, regulatory authorities, or affected third parties where required by law or where we believe disclosure is necessary to protect safety
• Pursue civil remedies for damages caused by violations

We will endeavor to provide notice before taking action where it is safe and practical to do so. However, we reserve the right to act immediately in cases involving serious harm, legal obligation, or ongoing platform abuse.

Account termination for AUP violations does not entitle you to a refund of any prepaid subscription fees.

If you become aware of any use of the Services that violates this AUP — including spam, abuse, illegal activity, or content that harms others — please report it to us immediately.

• We review all reports and take appropriate action. We may not be able to confirm the outcome of our investigation due to confidentiality, but we take every report seriously.

We may update this AUP from time to time as the Services evolve or legal requirements change. We will post the revised policy with a new effective date. For material changes, we will provide notice through the Services or by email.

Continued use of the Services after the effective date of any update constitutes acceptance of the revised AUP.
